1. About DrivenbyX

Drivenbyx is a technology platform that provides listings of public and private parking spaces. Drivenbyx does not own, lease, operate, manage, or control any parking spaces listed on the Platform. All parking spaces are owned and operated by third parties.

Drivenbyx acts solely as an intermediary and information provider.

2. No Responsibility for Parking Spaces

You acknowledge and agree that:

• Drivenbyx is not responsible for the condition, safety, legality, or availability of any parking space.
• Drivenbyx does not guarantee access to any listed parking space.
• Any agreement, use, or transaction related to a parking space is strictly between you and the space owner or operator.

3. Assumption of Risk

You use any parking space listed on Drivenbyx at your own risk.

Drivenbyx is not liable for:

• Theft, loss, or damage to vehicles
• Theft, loss, or damage to personal property
• Personal injury or death
• Towing, fines, tickets, or violations
• Acts or omissions of third parties

4. Limitation of Liability

To the fullest extent permitted by U.S. law, Drivenbyx, its owners, employees, affiliates, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to:

• Use of the Platform
• Use of any parking space
• Errors or inaccuracies in listings
• Service interruptions or platform downtime

5. No Warranties

The Platform is provided “AS IS” and “AS AVAILABLE.”
Drivenbyx makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

6. Payments, Banking & Financial Information

Drivenbyx is not a bank, payment processor, or financial institution.

• Payments may be handled by third-party payment providers
• Drivenbyx does not store or control your banking or payment information
• Drivenbyx is not responsible for payment errors, fraud, chargebacks, or unauthorized transactions

You agree that any financial disputes must be resolved with the payment provider or relevant third party.

7. Personal Information & Privacy

Your use of the Platform is also governed by our Privacy Policy.

• Drivenbyx is not responsible for data breaches caused by third parties
• You acknowledge that providing personal information online carries inherent risks

8. User Responsibilities

You agree to:

• Use the Platform lawfully
• Provide accurate information
• Comply with parking rules and local laws
• Respect property owners and other users

You may not misuse the Platform, attempt unauthorized access, or use it for illegal purposes.

9. Indemnification

You agree to indemnify and hold harmless Drivenbyx from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your use of any parking space
• Your violation of these Terms
• Your violation of any law or third-party rights

10. Termination

Drivenbyx reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason.

11. Changes to Terms

Drivenbyx may update these Terms at any time. Continued use of the Platform after changes means you accept the updated Terms.
